我国量刑程序的重构

Reconstruction of Sentencing Procedure in China

在本文中,笔者对我国量刑程序进行实证分析,并认为我国量刑程序具有内部化、精简化、方式多样化等特点,同时具有高效性和适应当前司法职权配置的优点,量刑程序固然要改革,但不能完全抛弃当前量刑程序的优点而盲目地照抄照搬。笔者还对量刑程序改革的必要性和可行性进行了分析,在此基础之上构建我国的量刑程序,就必须在量刑程序的模式上走一条兼具大陆国家合一模式和英美国家分离模式特点的混合式量刑程序。笔者站在便于改革和不影响诉讼效率的角度构建了我国量刑程序的具体制度。

In the thesis,the author first practically analyzes the sentencing procedure in China,and thinks that it has some characteristics and advantages;internalization,simplification,diversification,high efficiency,and adaptability of current judical power allocation.It is necessary to reform sentencing procedure without absolutely abandoning its merits.Then the thesis gives analysis on the necessity and feasibility of Sentencing Procedure＇s reform,and puts out the mode of combining China＇s unity mode and seperate mode of western countries in a scientific procedure reform.At last,the thesis constructs the system of sentencing procedure from the angel of reforming convenience and lawsuit efficiency.
