摘要
集体协商集体合同制度受到学术界相当多的质疑。在现行体制下完善集体协商集体合同制度,应将"被派遣劳动者"和"事业单位中适用劳动合同法的劳动者",这两类权益最容易受到侵害的劳动者包含在适用范围内;应强化"被代表方"(劳动者\职工)对"代表方"(工会)的法律约束力;应设定具有可操作性的有效的法律责任条款。
The system of collective consultation and collective contract is doubted by academic world.The legitimate rights and interests of laborers who are dispatched and the employees in an institutional unit should be protected by the above-mentioned legal system.And the rights and obligations of laborers and their representatives should be defined.Moreover,it is necessary to improve the regulations on legal responsibility.
