摘要
从国家主权、人权、环境权等多维视野对遗传资源的法律保护进行分析,认为多元化的分析有利于更好地认识遗传资源保护的本质目标和理论基础,有利于平衡发展中国家和发达国家之间的利益,有利于建立更加合理的遗传资源保护模式。因此,应该从全新的角度认识遗传资源的保护问题,将人权、环境权等人类共同利益作为保护的基础,在国家主权的框架下建立完善的遗传资源保护体系。
An analysis of the legal protection on genetic resource from the multiple perspective will contribute to abetter understanding of the essential objectives and theoretical foundation of genetic resource protection,a betterbalance of interests between developing and developed countries,and a more reasonable model of genetic resourceprotection.It is necessary to recognize the protection of genetic resource from the new point of view,human rights,environmental rights and other common interests of mankind as a basis for protection,in the framework of nationalresource from the multiple perspectiveSUN Hao-liang（School of Economic Law,Northwest University of Political Science and Law,Xi′an 710063,China） sovereignty to establish a perfect system of genetic resources protection.
