论市场机制在宅基地使用权流转中的限度

On the Limitation of Market Machinery in the Transferring of Right of Using Ground of House

当前我国农村已经分化为传统型农村和现代型农村两种类型。通过分别考察、探析这两种类型的农村宅基地使用权流转中完全引入市场机制所可能产生的影响,清晰地发现市场机制在稀缺性资源的配置上所具有的局限性同样存在于宅基地使用权的配置上。因此,在坚持"一户一宅"原则的前提下,在宅基地使用权流转制度的构建上,坚持"禁止城里人购买农村宅基地,允许宅基地在本集体成员间流转",应当是妥当、合理的选择。

At present,the countryside in our country has changed into two types： the traditional areas and modern areas.By studying the influence of market machinery on the transferring of grounds of house in the two types of countryside,we will find the limitation of market machinery that we have found on the distribution of scarce resources is also on the allocation of grounds of houses.Therefore,on the base of ＂one grounds of house one household＂,it is a rational choice to build the legal system of the right of using ground of house that prohibits unpeasants from buying the ground of house,meanwhile allows the collective members trade to buy each other.
