论美洲区域性人权保护和实施机制

American Regional Human Rights Protection and Implementation Mechanism

《美洲国家组织宪章》和《美洲人权公约》的通过和生效为建立美洲人权保护体系奠定了基础,依据这两个法律文书分别建立了两套并行的人权保护制度。《美洲人权公约》及其议定书所涵盖的内容体系十分完善,所建立的人权监督机构有:美洲国家间人权委员会和美洲国家间人权法院,这些机构对美洲人权保护的有效执行提供了保障。《美洲人权公约》突破了传统意义上的国际法人权主体理论,促进了区域性的国际人权保护;而《美洲国家组织宪章》框架下的人权监督和保护也发挥着重要作用。

The Charter of the Organization of American States and the American Convention on Human Rights were adopted and entered into force,which laid a foundation for American system of human rights protection.Based on these two legal instruments,two systems of human rights protection were established.The content system covered in the American Convention on Human Rights and its protocols is perfect.The monitoring organs are： the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights.These organizations ensure the effective implementation of American human rights protection.The American Convention on Human Rights broke through the theories about the traditional subjects of human rights from the perspective of international law,and promoted the protection of regional human rights,while the monitor and protection of human rights within the framework of the Charter of the Organization of American States has also played an important part.
