农村宅基地使用权流转问题探析

An Analysis of Transfer of the Right to Use Rural Housing Land

基于现实中农村宅基地使用权流转中存在着诸多的问题,检讨现行宅基地使用权流转制度,梳理现实宅基地使用权流转中存在的问题,在此基础上提出进一步完善农村宅基地流转的一些想法和建议。研究认为农村宅基地使用权应在允许进入流通领域放开流转,因势利导,依法管理,规范宅基地使用权的流转,建立有序的农村宅基地市场,取得农村宅基地流转改革新突破,从而为完善农村宅基地制度、盘活存量土地资源、活跃农村金融,进而为解决"三农"问题提供新途径。

This paper examines the current system of the transfer of rural residential land right of use and the corresponding problems, and puts forward some ideas and suggestions for further improving the transfer of the right. The research concludes that the rural residential land right of use should be allowed to transfer in the field of circulation and be managed according to the law so as to standardize circulation, improve the rural residential land system and achieve breakthrough in the reform of the transfer of rural residential land, thus providing a new way to resolve the problem related to the countryside, agriculture and farmers.
