论我国成年意定监护制度的构建

Construction of Adult Appointed Guardianship System of China

成年意定监护是一项符合现代监护理念的新制度,在我国立法上尚属空白。需要通过更新成年人监护立法理念,引进意定监护制度,采用法定监护和意定监护混合型立法模式,形成以意定监护制度为主,法定监护制度为辅助的新的成年人监护制度,以进一步完善我国成年人监护立法,更好地满足高龄老人、智力障碍者和身体残疾者的实际需要。

Adult appointed guardianship system, in conformity with modern guardianship theory, is a new one and blank in China＇ s legislation. We need update the idea of adult guardianship legislation, introduce appointed guardianship system, adopt the mixed mode of legal guardianship and appointed guardianship and form a new adult guardianship system （relying mainly on legal guardianship supplemented by appointed guardianship） to perfect our legislation and meet the real need of the aged , the retarded and the disabled.
