现有的特别补偿制度和SCOPIC条款存在诸多问题,需在海难救助法中建立相对独立的环境救助制度。这种新制度应克服现有制度之不足,有效激励救助人迅速施救,确立环境救助报酬并体现奖励性和独立性。

Because of the defects of the special compensation regime and SCOPIC clause, it is necessary to establish an independent environmental salvage regime in the law of salvage at sea. The new regime should eliminate the deficiencies existing in the present relief system. It should effectively encourage salvors to carry out salvage operations promptly. The new environmental salvage should be of awarding and independent nature.
