为落实和规范水运管理部门的监督检查职能,完善国内水运市场监管体系,在概述行政调查内涵与特征的基础上,辨析行政调查与监督检查、市场监管之间的关系,提出行政调查是水运部门履行行业管理职能、实现水运市场行为动态监管和改变监管理念、调动社会监督的重要制度,能真正使现有的监督检查制度运转起来。建立国内水运市场行政调查制度,应当通过立法明确其程序要求和相关法律责任。

In order to implement and standardize the waterway administrative departments＇ duty for inspection, and perfect the domestic shipping market regulation system, the paper analyzed the differences among administrative investigation, inspection and market regulation on the basis of summarizing the conception and character of administrative investigation. It pointed out that the administrative investigation is an important system for the waterway official departments to fulfill the management function, to supervise the domestic shipping market behavior dynamically, and to mobilize the power of social supervision instead of the traditional inspection perception, which can really make the existing inspection system operated. For the establishment of the administrative investigation system, it is necessary to set laws and rules to specify the procedures and related legal responsibilities.
