论建构环渤海区域立法协调机制的必要性

On necessity of constructing around Bohai regional legislative coordination mechanism

中央立法和地方立法都因各自所存在的弊端而难以满足环渤海区域合作与发展的法律需求,这就需要一种新型的立法模式——环渤海区域立法。环渤海区域立法建立在地方立法权合作基础之上,主要包括立法主体、立法权、立法程序和协调机制4个要素。协调性对于环渤海区域立法而言至关重要,它至少包括环渤海区域立法活动自身的协调、体系性协调和现实性协调3个方面。环渤海区域立法协调的实现最终需要借助于立法协调机制来进行,因此有必要构建系统而有效的环渤海区域立法协调机制。

Both central legislation and local legislation can not meet the demands of law in the cooperation and development process of around Bohai region because of their defects, which needs a new legislative model, that is around Bohai regional legislation. Around Bohai regional legislation bases on the cooperation of local legislative powers, mainly including legislative body, legislative power, legislative procedure and coordination mechanisms. Coordination is very important to around Bohai regional legislation, which covers at least three aspects, i.e. the coordination of around Bohai regional legislation activity itself, systematic coordination and realistic coordination. As the realization of around Bohai regional coordination relies on the legislative coordination mechanisms, it is necessary to construct systematic and effective around Bohai regional legislative coordination mechanisms.
