论TRIPS协议背景下我国的著作权保护法制建设

Construction of Legal System on Copyright Protection in China in the Context of TRIPS Agreement

在TRIPS协议背景下,我国著作权法针对TRIPS协议的要求进行了相应的修改,现有的著作权保护法律体系包括我国参加的有关版权保护的国际公约以及签署的双边或多边知识产权保护协议。我国在著作权保护方面取得了巨大的成就,但仍存在不少问题。构建和完善我国著作权保护制度应该遵循一定的基本原则,具体的战略措施和建议有:一、以TRIPS协议要求为参照,完善我国著作权保护的法律体系;二、强化著作权执法力度,加强法律教育和宣传;三、加强对TRIPS协议视角下著作权保护的专题研究,为立法提供理论依据。

In the context of TRIPS Agreement,China＇s copyright law makes adaption according to the requirements of TRIPS Agreement.The present copyright protection law system includes the international conventions that China involved in and the bilateral or multilateral intellectual property protection agreement that China signed.Copyright protection in the country has made great achievements,but there are still many problems.The construction of copyright protection system in China should abide by certain basic principles.Specific strategies and measures include：first,take TRIPS Agreement as reference,perfect legal system of copyright protection in China;second,strengthen copyright enforcement efforts to strengthen the legal education and advocacy;third,strengthen the thematic study on copyright protection under the TRIPS Agreement so as to provide a theoretical basis for the legislation.
