On the Structure of Three Patterns of Criminal Justice

目前各国解决犯罪问题的程序模式主要有三种:国家司法模式、协商性司法模式和恢复性司法模式。三者相互并存,互相补充。当今,解决犯罪问题的程序是以国家司法模式为主、以协商性司法模式和恢复性司法模式为补充;而今后将形成以恢复性司法为"主导型模式",协商性司法为"辅助型模式",传统国家司法为"兜底型模式"的刑事司法制度结构。它们将在最大程度上发挥各自的优势,以期达到犯罪行为发生后定纷止争、预防再犯的社会效果。

There are three patterns of criminal justice around the world： the pattern of national justice,the pattern of consultative justice and the pattern of restorative justice which coexist and complement each other.Currently the procedures to resolve criminal problems mainly rely on the pattern of national justice complemented by the pattern of consultative justice and the pattern of restorative justice.A new structure of criminal justice will be devised with the pattern of national justice as the dominant one,the pattern of consultative justice as the supplementary one and the pattern of restorative justice as the basic one.It will maximize the advantages of each pattern and achieve the effect of settling disputes and prevent crimes.
