摘要
非法转包、违法分包是工程建设领域涉及的主要违法违规行为,严重干扰了建筑市场的正常秩序。从该违法行为的基本概念和主要表现形式入手,对其现实危害性、法律后果与救济手段进行论述,同时对如何从程序和实体上进行鉴别和预防进行探讨。
Illegal transfer of contract and illegal subcontracting are major violations in project construction, which severely disrupts the function of construction market. Starting from the basic concept and major form of these two violations, this paper discusses the actual harm, legal consequence and means of redemption of these two violations. At the same time, this paper talks about ways of identification and prevention in the light of system and specific cases.
