摘要
2010年年底,中俄原油管道将建设完成,计划于2011年1月1日开始输油,该管道的建成投产将为保障中国能源安全供应发挥重要作用。管道建成后,不排除中俄双方在生态和环境、技术、商务、管道改造投资等方面发生争议的可能。与一般的国际贸易争端相比,跨国能源管道运输争议解决方法略有不同,具体包括政治外交途径和法律途径。对中俄原油管道可能发生的纠纷,同样可使用这两种方式来解决。为妥善解决中俄原油管道运输可能发生的争议,建议:1)抓住建立和发展国家间友好关系这一关键;2)在企业间运行合同中加入"如发生运输争端,一方不得因此停止或缩减运输数量,直到争端解决"的表述。
China-Russia oil pipeline will be completed by the end of 2010 and enter into operation on January 1,2011.The pipeline will play an important role in ensuring China's energy supply.However,it is hard to rule out the possibility of disputes between the two sides in environmental,technological,business,investment and other issues during operation.Generally speaking,there are two ways to solve the dispute over the oil pipeline operation-diplomatic channels and turning to a legal court.These are also the applicable choices in China-Russia oil pipeline issue.The article provides two suggestions to solve the dispute.Firstly,strengthening the relations between China and Russia as the key to ensure operation of the oil pipeline,which would make the legal liability a minor issue.Secondly,the condition that 'one party can not unilaterally stop or reduce the oil transport in case of disputes' is proposed to be added in the oil pipeline operation contract between companies.The Energy Chart Treaty contains the same condition,but Russia refused to accept it,for it might impede its energy diplomacy.However,from the Chinese point of view,this condition is a necessary part of the contract.
