《物权法》的颁布,初步确立了农村集体成员权制度,这是我国农村土地集体所有权制度上的一大进步,在一定程度上更好地保护了集体财产。但是法条的规定只是一个粗略的框架。通过对农村集体成员权与共有权、股权、建筑物区分所有权人成员权等权利的比较分析,进一步明确该权利的性质与价值,以更好地实现设立这一权利的初衷。

The issue of ＂The Real Right Law＂ has basically established the countryside collective member rights system,which is a great progress in the system of countryside collective land ownership of China.To a certain degree,it can protect the property of members.However,the law is just a framework.By comparing the right to other relative rights,such as stock right,etc,this article defines the value of the right,in order to better realizing the purpose of setting up this right.
