手机实名制可行性质疑及其法律对策

实施手机实名制,对打击利用手机进行违法犯罪、遏制非法有害信息泛滥具有重要的价值,但其可行性却面临质疑。实施手机实名制的直接法律依据缺失、个人信息保护制度不健全、假身份证泛滥、与运营商的商业利益相矛盾、可操作性不强、配套监管制度尚未同步等问题,是其面临质疑的主要原因。手机实名制应该实施且属可行,应该为手机实名制提供法律依据,健全个人信息保护制度,加强手机实名制实施的监管,为手机实名制的实施提供保障机制。

It is important to implement real name system of mobile phone when fighting against crimes by using mobile phone,stopping the spread of harmful information,but its feasibility is challenged.The main reasons to challenge the feasibility of the real name system of mobile phone are as follows： lacking direct legal basis,imperfect personal information protection system,proliferation of false testimony,contradiction with the commercial interests of operators,weak operability and asynchronous regulatory system.The real name system of mobile phone should be implemented and it＇s feasible.In order to deal with these challenges,we must accelerate the pace of making laws to provide the basis for real name system of mobile phone,improve the personal information protection system,strength internal management of telecom operators and supervision of the implementation to provide supporting systems for real name system of mobile phone.
