摘要
无因管理作为现代社会人们互助的一种方式,与人类文明与社会道德相吻合,已经受到了法律的肯定。但是,由于我国对其规定不是很完善,尤其在本人承认管理人的管理行为后双方权利义务关系不明确,因此在本人承认后的具体法律关系适用上需要进行研究。可从无因管理中本人承认的效力方面入手,来探析本人承认的性质、适用范围、拟适用的法律规定等,明晰本人承认后与管理人之间的权利义务关系及其法律适用问题。
As a way of mutual assistance in the modern society,Negotiorum Gestio has been affirmed by the law which is consistent with civilization and social ethics.The specific application of legal relations needs to be further investigated,because of the poor requirement of related regulation in China,especially the ambiguity of rights and obligations of two sides after the self-recognizer admits the management of administrator.Through the exploration of the nature,scope of application and legal provisions of self recognition and the self-recognizer's effectiveness in Negotiorum Gestio,this paper will make clear the rights and obligations between the administrator and self-recognizer and the application of law after self-recognition.
