从《春秋》决狱看中国义务论思想及其当代价值

Study on Chinese Deontology and Contemporary Value Based on "the Trial by Chun Qiu"

参照西方的义务论理论,分析我国传统文化中的义务论伦理思想,得出:我国传统文化中的义务论的伦理思想——尤其是《春秋》决狱制度——对依法治国与以德治国相结合的治国方略,有重要的借鉴意义。要认真研究传统的道德理论,并应用到现实实践中,尤其在司法实践过程中,应该充分考虑继承传统文化的理论精华。

According to the western deontological theory,this article analyses the deontology ethics in China＇s traditional culture.It points out that the deontology ethics of China＇s traditional cuture,especially ＂the Trial by Chun Qiu＂ has certain reference value for the combination of the rule of law between the rule of morality.The Traditional moral theory should be studied seriously and applied to the real practice.The essence of traditional culture should be given full consideration and succession in the process of judicial practice.
