浅析基因隐私权与基因知情权之冲突

An Analysis of the Conflic between Gene Privacy and Informed Right of knowing about Gene

基因隐私权在于权利主体有权就自己的基因隐私予以隐瞒和维护,不被外界所知悉。而基因知情权则是权利主体有权依法知悉和获取基因信息,保障其知情的权利。通过对两者之间的矛盾与冲突的分析研究,找出利益均衡点,从而实现维护整个社会公平与公正的目的。

Gene privacy means that the subject of the right has the right to conceal and protect one’s own gene,not being allowed to know by others. While,informed right about gene indicates that,according to the law,the subject of the right has the right to know his gene and therefore protect his right. By comparison,we analyze their differences and then find out their balance in order to maintain social fairness and justice.
