摘要
当前我国劳动关系日益多元化、复杂化,劳资矛盾激增。其根本原因就在于劳资关系失衡、劳资关系制衡机制欠缺。本文通过对劳资关系制衡机制概念的阐述,进而从我国劳资关系双方追求的目标入手,探讨分析当前我国劳资关系失衡的基本原因是公平与效率间的矛盾,强调以劳动权制约资本权的必要性,从而为我国构建劳资关系制衡机制提供理论依据。
Nowadays,labor relation in our country has become increasingly diverse and complex.Labor relation conflict surges.The fundamental reason is that imbalance in labor relations and lack of check and balance mechanism.Firstly,introducing the concept of the labor relation check-and-balance mechanism,then starting from the goal pursued by both employers and employees to discuss the basic reason of the imbalance.It is the conflict between fairness and efficiency,and emphasizing the necessity of labor rights restricts the capital right so as to provide the theoretical basis for building check-and-balance mechanism in our country.
