Reconstruction of Criminal Law Value System under the View of Harmonious Society

刑法的基本价值在于维护秩序,最高价值在于保障自由,维护秩序与保障自由之间的均衡、协调的比例就是和谐。刑罚是实现刑法的价值的基本载体,为达到和谐的终极价值,刑罚就必须以正义和人道作为基本的价值准则。正义是刑罚的基本价值,人道是刑罚的修正价值。人道价值暂时尚不能超越正义价值,而必须在正义价值的幅度内运行。

The basic value of criminal law is maintaining order while its superior value is defending free.The equipoise proportion between them is harmony.To achieve the ultimate value of harmony,penalty,as the basic carrier of realizing the values of criminal law,should observe the basic value of justice and humanism.Justice is the basic value of criminal law and humanism is revised value of criminal law.Humanism value could not surpass justice value for the moment,but must function within the range of justice value.
