摘要
ETF上市交易规则缺位,做市商制度不完善,"非交易过户"合法性受质疑,ETF发行方式单一,成立标准苛刻,"T+1"交易制度的限制,以上种种原因使得港股组合ETF在内地的发行面临重重障碍。因此,完善ETF运行的法律制度,保护一篮子股票的有效运转,丰富ETF的发行方式,完善做市商制度,确认"T+0"交易制度的合法性,设置与ETF配套的法律制度,是促进内地引入港股组合ETF的有效法律途径。
Due to the lack of ETF listing and trading rules,the imperfectness of the market-making system,the questioned legality of ＂non-exchange transfer＂,the single form of ETF issuance,the strict standard of incorporation,and the restriction on ＂T＋1＂ exchange system,the issuance of HK stocks combination ETF will encounter a variety of obstacles in Mainland.Therefore,the effective legal approaches promoting the introduction of HK ETF include：perfecting the legal system of EFT operation,protecting the effective operation of a basket of stocks,enriching the form of ETF issuance,perfecting the market-making system,confirming the legality of ＂T＋0＂exchange system,and establishing a legal system coordinated with ETF.
