Deep Analysis on Provisions of Definition of Chinese Inferior Drugs

目的为全面准确理解《药品管理法》关于劣药的界定及其处罚的条款提供参考。方法就我国现行法律对劣药界定的条款进行深层解析。结果与结论实践中对《药品管理法》研究最多、使用频次最高的条款莫过于对假、劣药的界定及其处罚条款。执法部门执法除了要认定违法事实,还要准确定性,才能准确适用法律予以制裁。

Objective To provide the reference for the full and correct understanding of Drug Administration Law On the definition and penalty provisions of inferior drugs.Methods The current provision of inferior drugs were deeply and comprehensively analyzed.Results and Conclusion In practice,the provisions of definition of counterfeit and inferior drugs（the Article 48st and 49st of current Drug Administration Law） and their corresponding penalty were the most studied and the highest frequently used.In addition to determination of the illegal facts,the law enforcement agencies should define illegality exactly in order to correctly apply laws and take sanction against noncompliance.
