建立知识产权侵权犯罪被侵害人救济保险制度

Research on the Introduction of Insurance System on the Remedy for the Victims of the Intellectual Property Crimes

知识产权犯罪作为一种对社会产生重要影响的犯罪形式,在近年来呈现出日渐猖獗的趋势。故在惩罚犯罪的同时,也应当注重对知识产权被害人权益的保护。然而,中国大陆目前对知识产权被害人救济的相关研究还处于起步阶段,被害人经常不能实现合法权益的充分维护,所受到的损失也难以得到足额赔付。鉴于此,笔者认为可以将知识产权保险制度引入被害人救济,以期更好维护知识产权犯罪被害人的权利。

As a type of crime which gives increasing important effect on modern society,intellectual property crimes take on a tendency of being rampant in recent years. We should not only punish this crime but also put enough emphasis on the protection of the victims. However,the research on the remedy for the victims of intellectual property crimes of is still in a groping stage,the rights of the victims can＇t be protected effectively,and commonly the victims could hardly get enough compensation. Therefore,in order to safeguard the rights of the victims,we should bring the insurance system into the Remedy for the Victims of the Intellectual Property Crimes.
