摘要
近几年随着房地产开发的增多,一些房地产开发商将正在建设的房屋进行一房多卖或房屋预售后抵押或售卖抵押房屋,并为此引起了诉讼的案例不断增多.然而,由于在商品房销售过程中房屋买卖双方或者三方所处时间的不同、动机的不同,导致最终行为定性的不同,因而适用不同的法律条款.因此,需要就开发商在售房过程中的"重复售房"行为进行性质的认定,并适用适当的法律解决争议.
With the increasing of real estate developmeat in recent years,some real estate developers sell a piece of real estate to more parties or mortgage real estate when real estate is under construction,and it induces legal cases increasing.However,similar behavior has different quality and subjects to different legal provisions because of buyers and sellers in different stages and motivations.This paper intends to identify the quality of repeatedly selling real estate action in the course of selling real estate and discuss the legal responsibility of real estate developers.
