摘要
根植于相对的意志自由、人文关怀、法的谦抑性的期待可能性理论,展现着强大的生命力。然而其判断标准,在理论上尚颇多争议。标准的不确定极易造成理论的滥用。通过对国内外该理论判断诸标准的考察,发现了各标准之间的贯通之处,揭示了其各自的优劣,指出应有一个综合的判断标准。
The theory of Anticipated possibilty rooted in the relative freedom of will,humane care and restraining criminal law shows great vitality.However,there are still many arguments on its judging criterion whose uncertainty is likely to give rise to the abuse of the theory.The paper discovers the connections of various judging criteria by researching into the judgment criteria home and abroad,reveals their respective advantages and disadvantages and concludes that there should be a comprehensive judgment criterion.
