摘要
民法与宪法关系问题在我国已成为理论界与实务界的焦点问题,出现了"泛宪法思维""超民法思维"等倾向。本文从性质层面、价值层面对宪法规范私法效力问题及对民法与宪法的关系进行比较分析,以期对我国实现二者关系的正确定位提供一些有益的启示。
The relation between the civil law and the constitution law has been a typical problem in our China with a tendency of constitution mentality and super civil law thinking.This essay will compare the relation between the civil law and the constitution law from the aspect of nature,value and the validity of the constitution governing the civil law and provide some beneficial enlightenment in order to realize correct definition in China.
