中国现实语境下赦免制度的适用分析

On Application Appropriateness of Remission Regulations in Chinese Realistic Context

新中国成立后曾有7次特赦的适用,自1975年以来,我国一直未再适用赦免制度。目前,有学者建议对普通刑犯实行特赦,以体现宽严相济的刑事政策,同时也契合社会和谐的旨趣。以赦免制度的利弊为切入点,并结合中国现实情境,展开赦免制度在当下中国适用的分析,最后结论为:目前我国缺乏赦免适用的现实条件,但是,开展赦免制度的研究是必要的。

There have been seven applications of amnesties since the foundation of PRC.This practice has never been implemented since 1975.On the 60th anniversary of PRC,some scholars suggested that the amnesty be used on the ordinary criminals so as to show the criminal strategy maintaining severity with tolerance and meanwhile to match the purport of the harmonious society.This paper starts with this point,discusses the advantages and the drawbacks of the remission regulations,and analyzes its prospective application in China by taking into consideration the Chinese realistic situations.It concludes that there is lack of the realistic conditions for the remission implementation in China,although this type of research is necessary.
