摘要
研究目的:为农用地抵押制度建立提供参考依据。研究方法:在分析农用地抵押争议点的基础上,结合龙泉驿区农用地流转的现状,采用文献资料法、法理分析法、中外比较法、实证研究法及收益还原法进行分析研究。研究结果:全面阐述了农用地抵押的必然性和可行性,探讨了农用地经营权抵押制度建设的问题,确定了农用地抵押的基准价格,提出了完善农用地抵押制度相关法规的建议及健全相关配套组织的设想。研究结论:在规范制约机制、明确抵押责任的前提下农用地抵押权可以实现,龙泉驿区试点对推广农用地抵押制度建设工作具有借鉴意义。
The purpose of this paper is to provide reference basis for the establishment of agricultural land mortgage system. Method employed is the combination of documentation, legal analysis, China-foreign comparison, empirical study and income approach, which is based on the dispute points of agricultural land mortgage and the current condition of agricultural land transfer in Longquanyi District. The results indicate: (1)the necessity and feasibility of agricultural land mortgage have been thoroughly illustrated;(2)problems related to the establishment of mortgage system for the contractual right of agricultural land have been discussed and the benchmark prices of agricultural land mortgage have been determined;(3 )suggestions on how to perfect the regulations of agricultural land mortgage system and the supplemented organizations have been proposed. It is concluded that under the preconditions of formal restriction mechanism and the clarification of mortgage responsibilities, the agricultural land mortgage right can be realized, and the trail of Longquanyi District can provide meaningful reference for the extension of agricultural land mortgage system in China.
