论我国先占制度之构建

On the buliding of the preemption system

先占作为所有权原始取得的一种方式,一直存在于我国的现实生活中,从我国的实际情况来看,先占制度构建的条件已经成熟。但我国《物权法》继《民法通则》之后再一次将之拒之门外,导致现今实际生活中大量的先占问题无法合理解决。因此,构建适合我国国情的先占制度,明确先占的基本范畴及构成要件,不仅可以填补我国先占立法的空白,而且可以为我国先占司法实践提供法律依据,这也就成为我国未来民法典的神圣使命。

As a way to origiral acquisition of owership,preemption exits on reallife in our country.As it turned out,the situation of preemption built is coming.But General Principles of Civiland Real Right Law don＇t involved,therefore,building preemption which is in keeping with China＇s specific national conditions not only filling the gap of law making,but also providing the merit in judicial practice.
