On Reviewing System of Intellectual Property Rights for Major Economic Activities

为保证重大经济活动的安全,防止我国企业在对外经济交往中遭受国外知识产权的伏击和避免自主知识产权的流失,在重大经济活动之前,应进行知识产权方面的审议、审查与可行性分析。重点审查所涉经济活动的知识产权在国内外的保护状况、权利主体的合法性、可能与他人知识产权发生权利冲突的风险等,并提出预防或减轻不良影响的对策和措施,以降低重大经济活动的知识产权风险,保障以政府投资为主体的重大经济活动顺利进行,保障我国重大经济活动健康有序的发展。

The intellectual property rights should be reviewed and analyzed in order to ensure the safety of the major economic activities,to prevent Chinese enterprises from ambush of intellectual property rights and to avoid the loss of independent intellectual property rights.The emphasis of consideration is the protection state of intellectual property rights at home and on abroad,the legitimacy of the right subject,and the possible risk of intellectual property rights.In the meanwhile,the countermeasures of preventing or mitigating the adverse effects should be given to reduce the risk of intellectual property rights,to ensure the major economic activities which the government investment is the mainstay to be carried out smoothly,and to protect the major economic activities in the healthy and orderly development.
