摘要
在现代法律文明之中,程序承载着对于法治、自由、人权等价值目标的功能意义;而程序正义作为一种法律理性价值在公共领域的应用,保障着公民的平等自由,同时也是公民诉讼权利实现的前提之一。在这种意义上,程序正义可以说是现代法律文明的理性价值之渊薮。
Among the modern legal culture,the program carries the rule of law,freedom,human rights,meaning the value of objective function;and procedural justice as a legal reason the value of the application in the public domain to protect the citizens,equality and freedom,but also civil rights lawsuit to achieve one of the prerequisites.In this sense,procedural justice can be said of modern legal culture hotbed of rational value.
