摘要
在根本上,源自美国的案例教学法与大陆法系成文法模式有冲突,我国运用案例教学目的并不明确。教学过程中,教师会面临案例资源匮乏、案例质量不易控制、教学主体适应性的考验、教学组织的匹配性不够等系统性问题。为了推动案例教学,我国应该明确案例教学的目的,组建完善的案例库,并调整教学结构。
The basic fact is that case method, stemming from the USA, conflicts with the continental legal system. Our country has not a clear purpose in using case method. While using case method, we will meet with many systematic defficulies, such as shortage of cases, losing control of the case quality, adaptability of teachers, and unsnitabe matching of teaching structure. To develop case method, our country should make definite the purpose of case method, construct integrate case database and adjust the teaching structure.
