摘要
从佘祥林到赵作海,"奇迹"惊人相似,成为现代司法不断复制的"耻辱"。错案频发,痛定思痛,除却表面的原因,制度设计、司法权力配置及运作中的弊端,都是导致错案的元凶。而坚守存弊的制度、变通规范的程序、践踏公民的权利及法律的尊严,根源则在于与现代司法格格不入的理念。
The ＂miracles＂ are amazingly similar from the case of Zhao Zuohai to the Case of She Xianglin. It has become a repeated shame of modern justice. In the frequent misjudged cases, besides the external reasons, the malpractice in system design as well as in the operation and distribution of judicial power are all the causes. The root of keeping wrong system, changing standard procedure and trampling civil rights and dignity of law lies in the concept which is out of tune with the modem justice.
