论我国农村集体土地所有权行使程序的重构

Toward Reconstructing Chinese Rural Collective Land Ownership Exercising Procedure

集体土地所有权行使程序的完善是我国农村土地制度改革的重要环节。但无论是立法还是实践,其程序都存在着严重的缺失而又不为大多数学者所重视。为此,以程序建构为视角,明确农村土地归属,确立所有权行使主体,重塑行使程序,重视程序立法,实为现行农村土地所有权制度建设所必需。

The improvement of the exercising procedure of Chinese rural collective land ownership is an important link in the reform of our rural land system. However,its procedure is very defective both in legislative and practice,which few scholars pay attention to. So,from the procedure perspective,redefining the ownership of rural land,establishing the exerciser of the ownership,rebuilding the exercise program,and improving the collective exercise procedure are a must for the building of the rural land system.
