摘要
劳动教养的存废问题,是近几年来争论较多的话题之一。在实践中,对劳动教养的适用也没有统一的标准,总结现行法律体制下的劳动教养制度,确有再进行深入探讨的必要。通过对劳动教养制度产生的历史背景、适用范围、以及与现行众多法律冲突的认识,可以使我们产生许多思考。可以说解决劳动教养制度与立法的冲突问题,是体现我国尊重人权的重要标志,也将是我国的社会主义法治迈向新的高度的表现。
Whether reservation or abolition of the reeducation through labor is a controversial topic in recent years. In practice, there is no uniform applied standard for the reeducation through labor. It is necessary to conduct a further research of the system. Through studying the historical background, the application scope of the system and the conflicts with the current laws, we can understand the significance to solve the conflict between the system of reeducation through labor and current legislation . It embodies the achievements achieved in respecting the human rights and in governing by laws in China.
