我国自助游存在的法律问题及对策思考

在国内自助游火爆发展的背景下,频繁出现的自助游意外事故凸显了政府监管和法律制度的缺位。该文分析了目前我国自助游发展的现状,对自助游发展过程中出现的诸如管理保障机制和法律法规缺位、事故责任不明确、自助游者防范法律风险意识淡漠等问题进行了初步论述。从建立完善的法律调控体系,严控自助游市场的准入门槛和界定自助游客的权利义务等三个方面提出了相应的对策思考。

The frequent accidents in self-help traval shows the absence of government regulation and legal system under the background of rapid development of domestie self-help tour. This paper analyzes the present situation of the development of China＇ s self-help tour, such as guarantee mechanism, laws and regulations, accident resposibility, self-help travellers＇ consciousness of legal risks etc, offering the corresponding coun-termeasures from three aspects, building perfect legal regulation system, controling self-help tour market access and the defining the rights and obligations of the self-help tourist.
