论刑事诉讼中照片的证据种类归属

在刑事诉讼中,照片是一种被广泛使用的证据。然而,对照片的证据种类归属问题实务界很少有人关注,理论界大多把照片归入物证、书证或者视听资料,理论研究的缺陷无法对司法实践起到正确的指引。细化照片的种类形式是研究照片证据种类归属的前提,根据刑事诉讼中照片不同的表现形式,可以把照片归入不同的证据种类中。

In the criminal proceedings,photos are widely used as a kind of evidences.However,few people pay attention to the ascription of evidence types of photos in practice,it is not uncommon that photos are attributed to real evidence,documentary evidence or audio-video materials in the theoretical field.The defects in the theoretical research on the ascription of photos can not give right guidelines to the judicial practice.It is the premise of research on the ascription of photos as evidence types that photos can be subdivided into various types.The author of this paper holds the opinion that photos can be subsumed into different evidence types according to their different forms in the criminal proceedings.
