摘要
德国法系各国民法中相邻关系的规定多以土地相邻关系为主,对建筑物区分所有下的相邻关系的规定多见于单行的区分所有权法律之中。我国《物权法》关于建筑物区分所有下的相邻关系的规定并不全面,应该在分析相邻关系的主体范围和规范性质的基础上,总结建筑物区分所有下相邻关系的新类型,借鉴德、日和我国台湾地区的经验,完善我国的立法。
Most civil law countries following GBG tradition confine adjacent relations to land adjacent relation.The regulations of adjacent relation under condominium buildings are mostly set in individual condominium law.China's "Property Law" didn't regulate the adjacent relation under condominium buildings comprehensively.Therefore,we should sum up new types of adjacent relations under condominium buildings based on the analysis of subject scope and normative nature of adjacent relations and draw on experiences from Germany,Japan and Taiwan of China to improve our legislation.
