东南亚宪政民主发展的路径与模式探略

The Analysis of the Path and Pattern for Southeast Asian Constitutionalism

宪政民主制度是现代政治文明的核心内容,二战后东南亚主要国家经历了由民主政治到威权政治,然后又回归民主的三部曲,形成了所谓的东南亚宪政主义。在第三波全球性民主化浪潮中,东南亚国家宪政的发展引人注目,其显示的特质、路径和模式与西方古典宪政相比具有若干不同之处。东南亚宪政主义发展的路径和模式表明,不能盲目照搬西方国家的经验和发展模式,而应该立足各国实际,建立适合东南亚地区国情的民主制度。

The constitutionalism system is the core of the modern political civilization.After the Second World War the countries in Southeast Asia experienced the democratic politics , authority politics, and the democracy, formed the so-called the constitutionalism principle. In the third-wave of global democratization, the development of the constitutionalism in Southeast Asia attracts people's attention. The article argues that the special characters, path and mode of the constitutionalism in Southeast Asian countries are different from the Western classical constitutionalism, that Southeast Asian countries should establish democratic system to accord with their national conditions based on each country's situation, and must not indiscriminately imitate the experience and development mode of the Western countries.
