对“电放提单”若干问题的法律思考

The Legal Thoughts of Several Issues to "Telecommunications Means The Bill of Lading"

集装箱运输节奏加快,提单晚于货物到达目的港的现象增加,尤其是近洋运输,货等单的问题给买方及港口都造成了不便,甚至损失。"电放提单"的问题在司法实际和航运实践中应引起重视,以促进航海贸易的顺利发展。通过分析关于"电放提单"的几个问题,指出尽管从经济学角度而言,"电放提单"是合乎情理的,但是在实际操作运用中,仍存在着诸多问题。最后,提出对"电放提单"立法的建议。

With the container transport towards quick-tempo,the phenomenon with a bill of lading arriving at the port of destination later than the goods raises,particularly in the last ocean transportation,the problems of goods waiting bills cause inconvenience and even losses to the buyer and the port.＂Telecommunications means the bill of lading＂ issue in the judicial and shipping practice should be paid more attention to promote the smooth development of maritime trade.Basing on the analysis of several issues of ＂telecommunications means the bill of lading ＂this paper points out that although the ＂telecommunications means the bill of lading＂ is reasonable from an economic point of view,many problems still exist in practice,at last,it puts forwards the legislative suggestions to ＂telecommunications means the bill of lading＂.
