摘要
我国食品安全信息发布存在公布主体分散、信息内容狭窄、公众参与缺失等问题。域外国家的经验告诉我们:食品安全监管公众参与至关重要,信息发布主体以统一发布为宜,信息内容以公开为原则。我国《食品安全法》设立了食品安全信息的统一公布制度;构建了"统一与分散相补充、中央与地方相结合"的信息发布网络;将食品安全信息分为"重要信息"和"日常信息",前者由卫生部门统一发布,后者由其他监管部门分散发布。完善我国食品安全信息公布制度,应落实职能部门之间的信息通报,设置"信息公开内部申请程序";通过法规和规章进一步明确列举主动公开食品安全信息的内容;建立统一的食品安全信息公开网站。
There are problems in the promulgation of food safety information in China: different promulgating subjects,narrow information content and lack of public participation.The experience of foreign countries tells us that public participation is essential and it is appropriate to disclose information by a unite body and that the food safety information should be disclosed in principle.The Food Safety Law of the People's Republic of China establishes a unite disclosure system;constructs a disclosing network of 'complementary to each other between the unified and the scattered body,combination between the central and the local governments';classifies the food Safety information into 'important information' and ' daily information',the former disclosed by the Ministry of health,the latter disclosed by the other supervision and administration departments.To improve the disclosing system of food safety information,we should carry out the system of information sharing between different departments,set up 'the internal application procedures for information';list the contents of the food safety information definitely through the statute and regulation;establish a unified website to promulgate the food safety information.
