摘要
在网络空间维持有序的市场竞争,必须尊重网络经济发展的客观规律,剖析网上竞争行为的特征,把握网上不正当竞争行为的表现形式,将传统的《反不正当竞争法》基本原理和网络经济的基本特征相结合,将法律规则与技术规范相结合,将国家干预与网络自治相结合,制订因应网络交易需要的法律,构建符合网络经济发展特征的网络市场不正当竞争法律规制体系。
