BIMCO Gulf of Mexico Oil Spill Clause

墨西哥湾漏油事故发生之后,波罗的海国际航运理事会(BIMCO)颁布了一项船东保护条款,用于程租船合同。

In response to the ongoing oil spill incident in the Gulf of Mexico, BIMCO has prepared an owners’ protective clause for use in voyage charter parties. The purpose of the Gulf of Mexico Oil Spill Clause for Voyage Charter Parties is to address owners’ concerns regarding possible delays and costs to vessels when ports and berths in the Gulf of Mexico area are nominated under a voyage charter. The scope of the Clause encompasses passage to or from such ports or berths where delays or costs may also arise. The objective of the clause is to address directly the current incident in the Gulf of Mexico (the BP Deepwater Horizon) rather than providing a more generic provision covering oil spills in general.
