我国道路交通事故概念的法律分析

Jurisprudential Analysis to the Concept of Road Traffic Accident in China

道路交通安全法对交通事故进行了重新界定,由此我国交通事故概念发生了重大变化;基于我国交通事故概念的发展,需要转变当前对交通事故概念的认识,明确交通事故形态从"单一过失"形态向"故意、过失与意外"多形态转变的思路,并对故意形态"交通事故"的法律制度进行剖析。

There has been an important change about the concept of road traffic accident, because its definition was defined again under 《Law of the People＇ s Republic of China on Road Traffic Safety》. So, we should change our traditional idea of road traffic accident and have a clear and definite thinking of form concerned, that is said, the thinking that is from ＂single negligence＂ form to ＂intention, negligence and unexpected＂ form, also we should analysis the legal system about intentional form of ＂traffic accident＂.
