直接型纯粹经济损失仅仅是受害人总体财产上的一种不利益,其发生并不以包括受害人自身在内的任何人受到有形损害为发生条件。这一类损失具有独立性、抽象性及受侵利益不具清晰轮廓和外延等特征。该类损失的赔偿实现问题关涉诉讼与责任泛滥的风险、责任的不确定、个人行动自由与纯粹经济利益之保护间的矛盾。直接型纯粹经济损失的赔偿问题仍然是法律上的利益衡量问题,责任的正当化基础在于行为人对受害人负有防免损失发生的义务。

Directly inflicted pure economic loss is the plaintiff＇s pure financial loss, without any physical injury to the plaintiff or any other person as well as their property. Such loss has independent, abstract and indiscernible characteristics. Its compensation is much related to such factors as the risk of the litigation and liabilities, and the contradiction between the protection of individual freedom and economic interests. In fact, from the legal perspective, its compensation is related to the balance of interests , that is, the defendant bears the duty of care for avoiding the plaintiff＇s losses.
