Effects of new Patent Law on patent application of agro-biotechnology in China

专利可促进农业生物技术的发展并保护所得的科研成果。适应中国经济发展的转变方式和专利申请快速增长的要求,中国于2009年底开始施行新专利法。新专利法对于动物和植物个体及其组成部分、转基因动物和植物、微生物、基因或蛋白序列、生物制品、诊断或治疗动植物疾病的方法以及上述内容的相关产业的应用等领域的专利保护产生了较大的影响,突出了对遗传资源的保护,重视申请国外专利的管理。

Developmet and research achievement may be protected by patent. In China, new Patent Law is implemented in the end of 2009, so as to adapt to change of economic development and to increase of patent application. New Patent Law On the basis of new Patent Law, Current situation and protection extent and patent application are explained in patent protection of agro-biotechnology in China , so as to provide experience for protection of intellectual property and patent application of agro-biotechnology.
