论农地征收对农村耕地的危害及法律对策——从立法和执法的角度

On Harm to the Cultivated Land for Collection of the Land and Its Law Countermeasures——From the Perspective of Legislation and Law Enforcement

耕地是农业生产发展的基本生产资料,是人类生存和社会发展的基础。征地导致农村耕地减少,危害粮食安全及生态安全。其主要原因有立法上的农地发展权的缺失和征地法律法规的不健全及执法上的行政执法的不严等。因此,必须采取相应的法律对策予以解决。

The cultivated land is the basic means of agricultural production and development,the human survival and social development foundation,also.The Land collection results in directly cultivated land reduced,which endangers national food security,and endangers ecological safety.The main reasons for them are that China's law is short of agricultural land right to development,the law of land collection is not strong,and without the strict enforcing law etc.So,it is resolved within the law countermeasures.
