Criterion Analysis of Transferring Modes for the 4-Waste Land of Contract and Management Rights

分析相关现行法规范,必须从相关法律、法规、司法解释中梳理出其规范内容,并对其立法旨趣与理论基础予以探寻和明晰。检讨相关现行法规范,发现在立法模式、规范设计的可操作性、规范设计的开放性三个方面存在明显的局限。坚持"效率优先、兼顾公平"的立法价值取向,整理出克服上述局限的基本思路为:放开流转方式的种类限制,同时设置各种流转方式适用的前提条件与程序性要求。因循此基本思路,可以提出改进相关现行法规范设计的具体方案。

To analysis the relevant valid legal criterion,we shall tease out its normative content from the relevant laws,regulations,judicial interpretations and we shall also clear its council value and theoretical basis.To review the relevant valid legal criterion,we found out clear limitations in the following three aspects: legislative model,operability and openness.Holding on the legislation value,'priority to efficiency with fairness',the basic idea is to overcome these limitations and to set the conditions and proceeding for the transferring models.So,according the basic idea,we propose specific programs to improve the relevant valid legal criterion.
