陕西煤炭矿山环境治理恢复保证金制度研究

矿山环境治理恢复保证金制度,是继补偿费后提出的通过市场经济手段有效保护矿山环境,防治在矿山开发过程中造成的环境破坏及诱发的地质灾害,促进经济社会可持续发展的一项经济激励措施。但是陕西煤炭矿山环境治理保证金制度还不够完善,不符合市场经济的要求,尚存征收主体与被征收主体的不完全市场性,征收标准过低以及相关利益主体环境保护行为的弱自律性等问题,针对这些问题建议保证金制度应加强监管惩罚力度,强化市场机制引入第三方等恢复治理矿山环境。

The system of coal mine rehabilitation bond is an effective economical measure that can protect mine environment and guard against geological disaster caused in exploiting mine following coal ecological compensation tax. But in Shaanxi this system is not perfect and fall short of marketing economy, which has many problems, such as incomplete marketability of both principal parts related with rehabilitation bond, low standard and weak consciousness of protecting environment ,etc. Therefore it is suggested that the government should enhance supervision and punishment and strengthen market mechanism to let the third party rehabilitate coal mine environment.
